ARTICLE 1 - PRICES :

1.1 The prices of our products are indicated in EURO TTC (all French taxes included) except forwarding costs and customs duties.

1.2 All orders placed on our site are payable in EURO.

1.3 Prices are valid for the current month. The products will be invoiced on the basis of the rates in force at the time of the recording of the orders, subject to availability at this date.

1.4 Reservation of ownership clause: the products remain the property of SAS AlpinStore until the full payment is received.

ARTICLE 2 - METHOD OF PAYMENT :

2.1 Payment by credit card:

We accept payments by credit card, either directly on the site in secure payment. SAS AlpinStore has installed a secure online payment platform (Banque Populaire).
Some orders paid by credit card may be subject to an additional verification. You will receive an email asking you for supporting documents in order to validate the sending of your order.

2.2 Payment by bank transfer:

You can also pay your order by bank transfer (possible expenses at the charge of the customer), by money order or with your Paypal account. on our account Banque Populaire

2.3 : Payment by FREE SCALAPAY PAYMENT OPTION:

SCALAPAY offers a free credit solution with no fees or interest, repayable in 3 installments. You pay the first instalment and you receive your order immediately, the next 2 instalments being charged to your card 30 and 60 days later. SCALAPYA is a company proposing solutions of payment on Internet - Head office: 33 rue Lafayette 75009 PARIS - 887 683 118 RCS Paris. The amount of the free credit varies between 150€ and 1500€. SCALAPAY is reserved for individuals (natural persons of legal age) residing in France, Germany or Italy and holding a Visa, American Express or MasterCard bank card with a validity date of 2 months or more after the purchase date.

Systematic authorization cards such as Electron, Maestro, Nickel etc... as well as e-cards and Indigo cards are not accepted. After completing his order, the customer must click on the "SCALAPAY 3 times payment button".

The customer is then redirected to the SCALAPAY web page displaying the summary of his order and the free credit request, which he must then validate.

SAS AlpinStore limits itself to putting its customers in contact with SCALAPAY by indicating a non-contractual landing page on its website. It is therefore not subject to the regulations relating to intermediaries in banking and payment services. In addition, if the customer asks to benefit from a financing solution proposed by SCALAPAY SAS, the information relating to his order and his identity (name, first name, postal address) will be transmitted to him. SCALAPAY will use this information to study the customer's request for the granting, management and collection of credit.

SCALAPAY reserves the right to accept or refuse his request for financing in 3 installments without charge. The customer has a withdrawal period of 14 calendar days to renounce to his free credit.


ARTICLE 3 - DELIVERY :

3.1 : Delivery of products

The ordered products will be delivered to the delivery address indicated by the customer at the time of the order according to the chosen mode of transport.

Packages will be delivered as soon as possible according to the delivery method selected at the time of the order.

The delivery times indicated on the site do not take into account weekends and public holidays. For countries outside the European Union or subject to customs formalities, any delays due to customs formalities.

Delivery rates include: the cost of transport, packaging and handling. Shipping costs are based on the weight of the package and the selected carrier. All shipping costs are displayed in euros including VAT.

All shipments are made with a tracking number and/or a signature at reception.

3.2 : Bulky and cumbersome parcels :

In cases where the goods in your order are too large or too heavy, and cannot be delivered with the mode of transport and the carrier that you have chosen, we will adapt the choice of carrier according to the package and the delivery requirements. The additional cost generated will be at our expense for deliveries in metropolitan France.

3.3 : Right of reserve :

In case of missing or damaged package impacting the product it is necessary to issue a reserve upon delivery. We ask you to check that the package is in conformity.

It is also recalled that the transfer of risk of loss or damage to the customer is made upon receipt by the customer of the order.

3.4 : Customs duty and local VAT outside the EU :

Any order shipped outside the European Union will automatically be invoiced tax free except for specific rules for UK. Import formalities, customs duties and taxes, if any, related to the delivery of an item outside the European Union are the sole responsibility of the Buyer. The Buyer is the only one responsible for checking the possibilities of importing the ordered products according to the law of the country of delivery. AlpinStore is not obliged to check and inform the Buyer of the applicable customs duties and taxes, in particular the local VAT.

Export to UK :
Since 1/1/2021, the VAT is applied as follows on your orders:
- Amount < £162: Local VAT paid directly at the order on our site, no additional payment required.
- Amount > £162 : Local VAT must be paid at the time of delivery to the local carrier + Administrative fees (£5 DPD & £11 DHL)

In case of refusal of the parcel for non-payment of the customs fees, Alpinstore will exclusively reimburse the products returned by the carrier.

ARTICLE 4 - RIGHT OF WITHDRAWAL:

You have the right to withdraw from the present contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day you, or a third party other than the carrier, takes physical possession of the Product.

4.1 : Exercise of the right of withdrawal :

In order for the withdrawal period to be respected, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the expiration of the withdrawal period.

4.1.2 : Modalities and return :

Following your request for return, we will send you a return label for shipment in France, Germany, Belgium, Spain and Luxembourg.

You will have to send back or return the good complete and in perfect condition, without excessive delay and specifying the order number to the following address

As part of our program "committed to true nature" to save our playground, we wanted to empower our community by requesting a support for returns to limit the environmental impact of unnecessary logistics:

- FRANCE & GERMANY : Participation of 6 € TTC for the orders lower than 119 € and free beyond with the transmitted transport voucher
- SPAIN, BELGIUM, LUXEMBOURG: participation 6 € TTC with the transmitted transport voucher
- OTHER COUNTRIES: Return at the expense of the customer in full

4.1.3 : Modalities and reimbursement :

In case of retraction, AlpinStore will reimburse the totality of the returned products without excessive delay and, in any case, at the latest seven (7) days from the day AlpinStore has received the return of your product.

We will proceed with the refund using a voucher valid for 12 months for returns under 150 € and via the same payment method you used for the initial transaction for refunds over 150 €.

AlpinStore reserves the right to defer the refund until it has received the Products or until you have provided proof of shipment of the Products, whichever comes first.


You will be responsible for any depreciation of the Products and their original packaging resulting from any handling of the Products that exceeds what is necessary to establish the nature, characteristics, proper functioning and marketability of the returned Product. In such a case, AlpinStore will inform you as soon as possible of the possible refusal of your refund and will return the damaged product.

4.2 : Exception to the right of withdrawal :

The exercise of the right of withdrawal is excluded in the following cases:

- contracts for the supply of goods that have been unsealed by the consumer after
delivery and that cannot be returned for reasons of hygiene or health protection (helmets, straps, ropes, climbing equipment ...),

- Products likely to deteriorate or expire quickly

- LProducts that may deteriorate or expire quickly, - Products that are personalized or made specifically for the client: drilled and mounted skis, sealskins cut to size, ropes cut to size, thermoformed shoes, ...

ARTICLE 5 - RESPONSIBILITY :

The products offered are in accordance with the French legislation in force and the standards applicable in France. Of course, for any question about the products you can contact our customer service. SAS AlpinStore cannot be held responsible for the non-execution of the contract in case of force majeure, flood, fire. Hypertext links can lead to other sites than the site AlpinStore. SAS Alpinstore is not responsible in case the content of these sites would contravene the legal and regulatory provisions in force.

Your personal information is intended for AlpinStore in order to process and ship your order, as well as to manage the commercial relationship with you and keep you informed of their offers and news. In accordance with the French law "Informatique & Libertés" n° 78-17 of January 6, 1978, you may at any time ask to access, modify, rectify or delete your personal information, or oppose to receive offers and information from AlpinStore, via the unsubscribe link present in each of our messages or by making a request through the online contact form.

AlpinStore, represented by its president, is responsible for the processing of personal data collected during the order process. The customer is also informed that the processing has been declared to the National Commission for Information Technology and Freedom under the number 1789421 of 26/08/2014

The present contract is subject to French law: any dispute settlement on a contract can be done with our customer service - claims by the contact form.

When validating your order, you validate your purchase and then you declare to accept its content as well as the general sales conditions of SAS AlpinStore. These general sales conditions are governed by French law. The customer accepts that ALPINSTORE can modify the present general conditions at a later date and within reason. Of course, only the conditions in force on the day of the order will be applied for all commercial relations between Alpinstore and its client.

The personal data collected on the site and then within the framework of the follow-up of our relations are used by the company Alpinstore and all its employees for the following purposes

ARTICLE 12 - SPONSORSHIP PROGRAM :

Sponsorship allows an AlpinStore customer to invite friends via their email address, personal blog, personal website to create an account on the site and to place an order while benefiting from advantages in the form of a gift certificate.

12.1 : Authorized sponsorship methods:

12.2 Prohibited sponsorship methods:

It is strictly forbidden to use a referral code as a promotion or discount code. The sites of promotional codes or similar are strictly forbidden.

Any prohibited use exposes you to the deletion of your sponsorship credit and the order made.

ARTICLE 13 - GUARANTEES :

13.1 Legal warranties:

The Products supplied by AlpinStore benefit, in accordance with the legal provisions :

- the legal guarantee of conformity under the conditions of articles L.217-4 and following of the Consumer Code,

- the guarantee against hidden defects resulting from a material, design or manufacturing defect affecting the Products delivered and making them unfit for use, under the conditions provided for in articles 1641 and following of the Civil Code.

13.2 Legal guarantee of conformity :

  • Article L217-4 of the French Consumer Code: the seller is required to deliver goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery.

He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility.

  • Article L217-5 of the Consumer Code:

the good is in conformity with the contract:

1° If it is suitable for the use usually expected of a similar good and, if necessary :

- if it corresponds to the description given by the seller and has the qualities that he presented to the buyer in the form of a sample or model;

- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labelling;

2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter.

13.3 Guarantee of hidden defects:

  • Article 1641 of the Civil Code: the seller is bound by the warranty for hidden defects of the thing sold that make it unfit for the purpose for which it was intended, or that so diminish this use that the buyer would not have acquired it, or would have given only a lower price, if he had known about them.
  • Article 1648 paragraph 1 of the Civil Code: the action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect.

In the case provided for in Article 1642-1, the action must be brought, under penalty of foreclosure, within one year of the date on which the seller can be discharged from the defects or apparent defects of conformity.

13.4 Enforcement:

You have a period of two (2) years to act, starting from the delivery of the Product.

You may choose between repairing or replacing the Product, provided that this choice does not entail a cost that is clearly disproportionate to the value of the Product or the importance of the defect. AlpinStore is then obliged to proceed, unless this is impossible, according to the method chosen by you.

You are exempted from proving the existence of the defect of conformity of the Product during the twenty-four (24) months following the delivery of the Product.

The legal warranty of conformity applies independently of any commercial warranty that may have been granted.

2. Warranty for hidden defects

If you decide to implement the warranty for hidden defects as defined in Article 1641 of the Civil Code, you can choose between the resolution of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.

13.5 Contractual warranty :

In addition, you can, if necessary, benefit from the manufacturer's warranty of the Products that AlpinStore commercializes.

In order to be able to invoke the benefit of the contractual guarantee that may be applicable, you must notify AlpinStore without delay and in writing, of the defects that you attribute to the Products and provide all justifications as to the reality of these. You must provide us with the following information using the SAV form in the customer service section https://www.alpinstore.com/fr/contactez-nous:

- Name, first name and order number as well as a copy of your invoice;

- Photos of the Products with the damage or deterioration clearly visible;

- Precise explanation of the defect.

Once we have received the complete file, we will give you the instructions to follow according to the indications communicated by the manufacturer of the Product in question.

You must give AlpinStore or the manufacturer every facility to proceed to the observation of these defects and to remedy them. If the manufacturer requests the return of the Product, you will be responsible for the return shipping costs. Eventual processing fees (return of the products to our suppliers + processing fees) may be requested if this has to be done by AlpinStore. 15 € (Metropolitan France) / 30 € (European Union / Switzerland and Norway) / 50 € (Rest of the world).

The manufacturer will proceed to a detailed expertise of the Product for a possible coverage under the warranty and will make sure that the defect does not come from an abnormal use of the Product.

AlpinStore informs you that only the manufacturer makes the decision and that we follow his decision.

13.6 Any warranty is excluded in case of use or storage of the Products not in accordance with the provisions on the label attached to the Products.

13.7 AlpinStore will not be considered responsible or in default if it proves that the delay or non-performance is due to the occurrence of a case of force majeure or is attributable to you (abnormal or non-conforming use of the Products, use not in conformity with the use for which the Product is intended, etc.).
